1. Terms of Service

Overview

Welcome to Vermart. Vermart is a curated cross-border wellness and essentials retailer operated by Fitamin Supplements Inc., doing business as Vermart. Throughout these Terms, “Vermart,” “we,” “us,” and “our” refer to Fitamin Supplements Inc. and the Vermart website, services, and related sales channels.

By visiting our website, placing an order, creating an account, contacting us, submitting content, or using any Vermart service, you agree to these Terms of Service and all related policies referenced on our website, including our Shipping Policy, Return & Refund Policy, Customs & Duties Policy, Healthcare Disclaimer, Privacy Policy, Product Authenticity Policy, and Intellectual Property Policy.

If you do not agree with these Terms, please do not use our website or services.

Who May Use Vermart

Vermart is intended for use by customers who are at least the age of majority in their province, state, or country of residence, or who are using the website under the supervision and consent of a parent or legal guardian.

By placing an order, you confirm that you are legally able to purchase the products in your order and that the products are permitted for import, possession, and use in your destination country, state, province, or region.

Certain wellness, supplement, personal care, OTC, or age-sensitive products may not be suitable for all customers. Please read all product labels, warnings, ingredients, and usage instructions before purchase and use.

Our Business Model

Vermart is a curated cross-border wellness and essentials retailer. Vermart does not currently operate as an open third-party seller marketplace. Products are curated and fulfilled through Vermart’s own sourcing, retail, distribution, wholesale, brand, or fulfillment partners.

Most Vermart orders currently ship from Canada to international customers. As Vermart grows, some products may also ship from the United States or other supported fulfillment locations depending on product availability, customer destination, carrier network, and operational requirements.

Products are sourced from reputable retail, wholesale, brand, distribution, and fulfillment partners. Unless clearly stated otherwise, Vermart does not claim to be the manufacturer, exclusive distributor, official brand store, or authorized reseller of every brand listed on our website.

Brand names, trademarks, product names, and manufacturer references are used for product identification, resale, compatibility, and informational purposes only. Their appearance on Vermart does not imply sponsorship, endorsement, affiliation, authorization, or partnership unless expressly stated.

Product Information

We work to provide accurate product titles, descriptions, images, prices, ingredients, usage details, availability, and shipping information. However, product information may change without notice.

Manufacturers may update packaging, ingredients, formulas, labels, country versions, warnings, dosage instructions, or product images. Product packaging, ingredients, labels, and warnings may vary by region or manufacturer update.

Customers are responsible for reading the product label, ingredient list, warnings, expiration information, and manufacturer instructions before using any product. If there is any difference between website information and the physical product label, the physical product label and manufacturer instructions should be followed.

Product Availability and Order Acceptance

All orders are subject to acceptance, product availability, payment approval, fraud screening, shipping feasibility, and compliance review.

We reserve the right to refuse, cancel, limit, or modify any order at any time, including but not limited to orders involving suspected fraud, unauthorized payment activity, incorrect pricing, unavailable products, restricted shipping destinations, import concerns, high-risk addresses, freight forwarding risk, unusual purchase quantities, resale abuse, policy misuse, or suspected violation of laws, regulations, or platform rules.

If we cancel an order after payment has been processed, we will issue any applicable refund to the original payment method, subject to our refund policies and any applicable deductions for orders already processed, shipped, refused, abandoned, or returned.

Pricing, Currency, and Errors

Prices are listed in the currency shown at checkout. Prices, promotions, discounts, shipping fees, taxes, and duties may change without notice.

Although we make reasonable efforts to keep information accurate, errors may occur. If a product is listed with incorrect pricing, incorrect shipping charges, incorrect duty/tax estimates, incorrect availability, or incorrect product details, we reserve the right to cancel or correct the order.

We are not obligated to fulfill orders based on obvious pricing errors, system errors, marketplace sync errors, supplier feed errors, currency conversion errors, or typographical mistakes.

Payments

By placing an order, you authorize Vermart and its payment processors to charge your selected payment method for the order total shown at checkout, including product price, shipping, taxes, duties, fees, and any other applicable charges.

All payments are subject to approval by the payment provider. Vermart is not responsible for payment delays, bank holds, authorization issues, currency conversion fees, foreign transaction fees, or payment processor declines.

Fraud Prevention and Verification

To protect our customers, business, payment processors, and shipping partners, Vermart may review orders for fraud, unauthorized payment use, suspicious activity, unusual order patterns, freight forwarding risk, address mismatch, payment mismatch, or chargeback risk.

We may request additional verification before fulfilling an order. This may include confirmation of billing information, shipping address, payment authorization, identity verification for high-risk orders, or other reasonable information needed to confirm the transaction.

Failure to complete requested verification may result in order cancellation. Vermart reserves the right to refuse service, cancel orders, restrict accounts, or decline future transactions where we reasonably believe there is fraud, abuse, suspicious activity, chargeback risk, or violation of our policies.

International Orders

Most Vermart orders currently ship from Canada to international customers. Customers are responsible for confirming that products may be legally imported into their destination country before ordering. If Vermart later ships from other fulfillment locations, similar destination-country import rules may apply.

International orders may be subject to customs inspection, import rules, duties, taxes, brokerage charges, delivery delays, documentation requirements, restrictions, or refusal by local authorities.

Customs authorities may delay, inspect, reassess, reject, seize, destroy, return, or refuse shipments at their discretion. Vermart is not responsible for decisions made by customs authorities, postal authorities, health regulators, border agencies, or local government offices.

Health, Wellness, Supplement, and OTC Disclaimer

Vermart is not a medical provider, pharmacy, healthcare professional, or manufacturer of the products sold on our website unless clearly stated.

Information on our website is provided for general informational and shopping purposes only and is not medical advice, diagnosis, treatment, or a substitute for professional healthcare guidance.

Products sold by Vermart are not intended to diagnose, treat, cure, or prevent any disease unless specifically permitted by applicable law and stated by the product manufacturer.

Third-party brand names, logos, product names, trademarks, images, and manufacturer references remain the property of their respective owners. Their appearance on Vermart does not imply sponsorship, endorsement, affiliation, authorization, or partnership unless expressly stated.

User Content, Reviews, and Submissions

If you submit reviews, photos, comments, messages, testimonials, feedback, or other content to Vermart, you grant Vermart a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, display, edit, translate, and distribute that content for business, marketing, customer support, and website purposes, subject to applicable law.

You agree not to submit content that is false, misleading, defamatory, abusive, unlawful, infringing, obscene, spam-like, harmful, or containing improper medical claims.

We reserve the right to remove, edit, reject, or moderate user-submitted content at our discretion.

Prohibited Uses

You may not use Vermart.com or our services to violate any law, purchase products restricted in your location, commit fraud or payment abuse, submit false information, infringe intellectual property rights, interfere with website security, scrape or misuse website content, abuse promotions or refunds, resell products in violation of laws or brand restrictions, or engage in activity that harms Vermart, our customers, partners, or service providers.

Limitation of Liability

To the fullest extent permitted by law, Vermart and its owners, directors, officers, employees, contractors, suppliers, fulfillment partners, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of our website, products, services, shipping, customs events, delays, product use, order cancellations, or policy enforcement.

To the fullest extent permitted by law, Vermart’s maximum liability for any claim related to an order will not exceed the amount actually paid by the customer for the specific product or order giving rise to the claim.

Nothing in these Terms or any Vermart policy limits customer rights that cannot legally be limited under applicable law.

No Guarantee of Results

Wellness, supplement, beauty, skincare, personal care, and related products may work differently for different individuals. Vermart does not guarantee specific health, wellness, beauty, fitness, therapeutic, or lifestyle results.

Force Majeure

Vermart is not responsible for delays, failures, losses, or inability to perform caused by events beyond our reasonable control, including customs delays, border inspections, carrier disruptions, strikes, supply shortages, weather events, natural disasters, pandemics, government actions, regulatory changes, payment processor outages, technology failures, or supplier disruptions.

Governing Law

These Terms and any dispute involving Vermart are governed by the laws of British Columbia and the applicable federal laws of Canada, unless mandatory consumer protection laws in your jurisdiction require otherwise.

You agree that disputes will be handled in British Columbia, Canada, unless applicable law requires another venue.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date. Continued use of our website or services after changes are posted means you accept the updated Terms.

2. Shipping Policy

Overview

Vermart ships wellness products, supplements, personal care items, beauty products, grocery products, baby products, and everyday essentials across supported destinations.

Our goal is to provide a reliable, transparent, and customer-friendly cross-border shopping experience. Because many Vermart orders involve international fulfillment, delivery times and customs processing may vary by destination.

Fulfillment Locations

Most Vermart orders currently ship from Canada. As Vermart grows, certain products may also ship from the United States or other supported fulfillment locations.

Depending on product availability, customer destination, carrier network, and operational requirements, your order may ship from Canada, the United States, a Vermart fulfillment partner, a retail/wholesale/distribution partner, or another supported fulfillment location.

Orders with multiple products may arrive in separate packages.

Processing Time

Orders usually ship within 1–3 business days under normal conditions after payment approval, fraud screening, product availability confirmation, and shipping feasibility review.

Processing may take longer for high-value orders, international orders, items requiring special handling, supplier availability checks, address issues, or orders requiring customer verification.

Delivery Estimates

Delivery estimates shown at checkout are estimates only and are not guaranteed unless a specific guaranteed service is clearly offered and confirmed in writing.

After Vermart hands the shipment to the carrier, the carrier may update routing, delivery timelines, pickup requirements, or local delivery handling based on its network and destination-country conditions.

Delivery times may be affected by carrier delays, customs inspection, international border processing, weather events, high-volume seasons, incorrect addresses, remote delivery areas, local holidays, customer availability, documentation requests, payment verification, or product availability.

Vermart is not responsible for carrier or customs delays outside our control.

Tracking

When tracking is available, tracking details will be provided by email or through your order status page.

Tracking updates may take time to appear after a label is created. International tracking may pause while shipments move between carriers, countries, customs facilities, or local delivery partners.

Address Accuracy

Customers are responsible for providing a complete and accurate shipping address, including apartment/unit number, postal code, phone number, and any required delivery details.

Vermart is not responsible for delays, losses, returns, or delivery failures caused by incorrect, incomplete, outdated, or undeliverable addresses provided by the customer.

If an order is returned due to address issues, shipping fees, return shipping, customs fees, carrier fees, and handling costs may be deducted from any eligible refund.

Delivery Attempts and Pickup Locations

Some carriers may deliver to the address provided, while others may leave a notice for pickup at a local post office, parcel locker, access point, courier branch, or pickup location.

Once a shipment is marked as available for pickup, the customer is responsible for collecting it within the carrier’s required timeframe.

If a package is not collected, refused, abandoned, or returned due to missed delivery attempts, unpaid fees, or customer inaction, Vermart may deduct original shipping, return shipping, customs charges, carrier fees, and handling costs from any eligible refund.

Lost Packages

If tracking shows no movement for an unusual period or the carrier confirms a package is lost, please contact support@vermart.com.

We may open an investigation with the carrier. Refunds or replacements for lost packages are handled case by case after carrier review and confirmation.

Vermart is not responsible for packages confirmed as delivered by the carrier, except where required by law or where the carrier confirms a delivery error.

Delivered but Not Received

If tracking shows delivered but you did not receive the package, please check around your delivery location, ask household members/building staff/neighbours/mailroom staff, contact the local carrier, and contact Vermart support within 5 calendar days of the delivery scan.

We will do our best to assist, but we cannot guarantee refunds or replacements for packages marked delivered by the carrier.

Restricted Products and Destinations

Certain products may not be eligible for shipping to all destinations due to carrier rules, customs restrictions, product ingredients, health regulations, brand restrictions, hazardous materials rules, temperature sensitivity, or local laws.

We reserve the right to cancel any order that we believe cannot be shipped safely, legally, or reliably.

Shipping Fees

Shipping fees are shown at checkout where available. Shipping fees may vary based on destination, product weight, product type, carrier service, taxes, duties, and fulfillment requirements.

Original shipping charges are generally non-refundable once an order has shipped, unless the issue is caused by Vermart error or otherwise required by law.


3. Customs, Duties & Import Policy

Overview

Vermart is a cross-border wellness and essentials retailer. Most Vermart orders currently ship from Canada to international customers. Customs rules differ by country, state, province, and product category.

This policy explains how duties, taxes, customs clearance, import restrictions, documentation requests, and customs-related returns are handled.

Customer Responsibility for Import Eligibility

Before placing an order, customers are responsible for confirming that the products in their order may legally be imported, possessed, and used in the destination country, state, province, or region.

This is especially important for supplements, vitamins, OTC products, eye care products, skincare, cosmetics, grocery, baby products, personal care products, products with active ingredients, and products regulated differently between countries.

Some products that are legally sold in Canada may be restricted, require documentation, require a prescription, or be prohibited in another country. Vermart cannot guarantee that local authorities will permit import of every product into every destination.

Customs Inspections and Government Decisions

Customs authorities, health regulators, postal authorities, and border agencies may inspect, delay, reassess, reject, seize, destroy, return, or refuse shipments at their discretion.

Vermart is not responsible for customs decisions, border agency decisions, local regulatory actions, or government enforcement decisions.

Duties, Taxes, and Fees

Depending on the destination and checkout setup, duties, import taxes, tariffs, VAT, GST, brokerage fees, handling fees, or other import charges may be included or estimated at checkout, prepaid where available, collected by the carrier or customs authority upon import, reassessed after shipment, or charged separately by local authorities.

Vermart aims to minimize unexpected import charges where possible. However, customs authorities may independently reassess product classification, shipment value, origin, duties, taxes, or fees.

Any additional charges imposed by customs authorities, carriers, brokers, postal operators, or local government agencies remain the responsibility of the customer unless Vermart expressly agrees otherwise in writing.

Prepaid Duties and Reassessment

For some destinations, Vermart may offer prepaid duties/taxes or duty-inclusive checkout options. Where this option is available, we make reasonable efforts to estimate and collect applicable charges accurately.

However, customs authorities may still reassess shipments based on their own rules, valuation methods, classifications, exchange rates, or documentation requirements. If local authorities impose additional charges, request documents, or require customer action, the customer is responsible for responding promptly and paying any additional amounts required for clearance, unless otherwise required by law.

Required Documents, Permits, or Prescriptions

Some countries may require customers to provide personal identification, tax identification numbers, import permits, product-use declarations, prescriptions, health certificates, proof of purchase, customs forms, or other documents requested by local authorities.

The customer is responsible for providing required documents on time. Delays or failure to provide documents may result in storage fees, return, abandonment, destruction, or refusal of the shipment.

Customs Holds, Refusals, Seizures, and Returns

If an order is held, refused, returned, seized, destroyed, or abandoned due to customs restrictions, unpaid duties/taxes, missing documents, local import rules, customer inaction, or refusal to accept delivery, Vermart may not be able to recover the shipment or product value.

Where a refund is possible, the refund may be reduced by original shipping fees, return shipping fees, customs duties, import taxes, brokerage charges, carrier fees, storage fees, handling fees, payment processing fees, restocking fees, and non-recoverable product costs.

For health, supplement, grocery, baby, personal care, and hygiene-sensitive products, returned items may not be resellable and may be excluded from refund eligibility depending on condition and applicable rules.

Customer Refusal to Pay Import Charges

If a customer refuses to pay required customs charges, import fees, duties, taxes, or carrier charges, the shipment may be returned, delayed, abandoned, destroyed, or seized.

In such cases, any eligible refund may be reduced by the costs listed above. In some cases, no refund may be available if the shipment cannot be recovered or the product cannot be resold.

Country-Specific Restrictions

Vermart may provide general product information, but we cannot provide legal advice about every destination country’s import rules.

Customers should contact their local customs office, health authority, postal operator, or licensed professional before ordering restricted or regulated products.

No Guarantee of Customs Clearance

Vermart works in good faith to ship compliant orders using available carrier and customs processes. However, we do not guarantee that every shipment will clear customs in every country.

Customs clearance is controlled by the destination country’s authorities.


4. Return & Refund Policy

Overview

Vermart wants customers to receive products safely, accurately, and in good condition. Because many of our products are wellness, supplement, personal care, grocery, baby, beauty, OTC, or hygiene-sensitive items, returns are limited for health, safety, and cross-border reasons.

This policy is designed to be fair to customers while protecting product safety, compliance, and international shipping costs.

Nothing in this policy limits customer rights that cannot legally be limited under applicable law.

Return Eligibility

Returns or refunds may be available for damaged products, defective products, incorrect items sent by Vermart, missing items from an order, carrier-confirmed lost shipments, or other issues approved by Vermart support.

Customers must contact support@vermart.com within 7 calendar days of delivery for damaged, defective, incorrect, or missing items.

Evidence Required

To help us resolve issues quickly, we may request order number, photos or videos of the damaged or incorrect item, photos of the shipping box and label, photos of packaging material, batch/lot/expiry information if applicable, carrier notice or customs notice if applicable, or any other information reasonably needed to investigate the issue.

Failure to provide requested information may delay or prevent refund approval.

Non-Returnable Items

For health, safety, hygiene, regulatory, and resale reasons, the following items are generally non-returnable unless they arrived damaged, defective, or incorrect:

Opened supplements, vitamins, ingestible products, OTC products, grocery and food products, baby feeding or baby care products, personal care products, skincare and cosmetics that have been opened or used, hygiene-sensitive items, temperature-sensitive items, clearance/final sale items, products with broken seals, products without original packaging, and products returned due to buyer remorse after international shipment.

Buyer Remorse Returns

Because cross-border shipping is costly and many products cannot be resold after return, Vermart is not required to accept buyer remorse returns for international orders.

If Vermart approves a buyer remorse return as a courtesy, the customer is responsible for original shipping cost, return shipping cost, duties, taxes, brokerage, customs fees, safe packaging, return tracking, and any loss or damage during return shipping.

Approved buyer remorse returns may be subject to a minimum 25% restocking and handling fee, plus any non-recoverable shipping, customs, payment processing, and carrier costs.

Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, or incorrect, contact us within 7 calendar days of delivery.

If approved, Vermart may offer a replacement, store credit, partial refund, full refund for the affected item, or another reasonable solution based on the circumstances.

We may not require return of damaged or unsafe items where return shipping is impractical, unsafe, or not required for investigation.

Lost Shipments

If a shipment is confirmed lost by the carrier, Vermart may offer a replacement, refund, or store credit after carrier investigation.

Packages marked delivered by the carrier are not automatically considered lost. Delivered-but-not-received claims are reviewed case by case.

Customs Refusals, Import Rejections, and Regulatory Holds

If an order is refused, returned, seized, destroyed, abandoned, or rejected by customs or local authorities due to import restrictions, unpaid charges, missing documents, prescription requirements, permits, customer inaction, or local regulatory rules, refund eligibility may be limited.

Where a refund is possible, Vermart may deduct original shipping, return shipping, customs charges, duties and taxes, brokerage fees, storage fees, carrier fees, payment processing fees, handling fees, product losses, and a restocking fee where applicable.

In some cases, no refund may be available if the shipment cannot be recovered, is destroyed by authorities, or contains non-returnable product categories.

Refused, Unclaimed, or Abandoned Packages

If a package is refused, not collected from a pickup location, abandoned, returned due to failed delivery attempts, or returned because the customer did not respond to carrier/customs requests, any eligible refund may be reduced by all related costs.

Original shipping charges are generally non-refundable once an order has shipped.

Refund Method and Timing

Approved refunds are issued to the original payment method unless otherwise agreed.

Refund timing depends on payment provider processing times and bank policies. Vermart is not responsible for bank delays after a refund is issued.

Maximum Remedy

To the fullest extent permitted by law, Vermart’s maximum responsibility for an order issue is limited to the amount paid for the affected product or order. Vermart is not responsible for indirect losses, inconvenience, missed events, business losses, health outcomes, replacement purchases, currency conversion fees, or other consequential damages.

Nothing in this policy limits rights that cannot legally be limited under applicable consumer protection laws.

Vermart is not a doctor, pharmacy, medical clinic, healthcare provider, manufacturer, or professional healthcare advisor.

Unless expressly stated by the manufacturer and permitted by applicable law, products sold on Vermart are not intended to diagnose, treat, cure, or prevent any disease.

Customers are responsible for reviewing product labels, ingredient lists, allergen warnings, dosage instructions, expiry dates, contraindications, and manufacturer directions before use.

If you have allergies, sensitivities, dietary restrictions, medical conditions, or ingredient concerns, do not use a product until you have confirmed it is suitable with a qualified professional.

Regional Product Differences

Products may vary by country or region. Packaging, ingredient listings, dosage forms, label languages, warning statements, regulatory markings, and manufacturer claims may differ depending on the product version.

Customers are responsible for confirming that the product version they purchase is suitable and permitted in their location.

Product Misuse

Vermart is not responsible for harm, adverse reactions, injury, loss, or damage caused by misuse, overuse, improper storage, failure to follow label directions, use contrary to medical advice, use after expiry, allergic reactions, or use in violation of local laws or regulations.

Emergency Situations

If you experience a medical emergency or serious adverse reaction, stop using the product and seek immediate medical attention. Do not rely on Vermart customer support for emergency medical advice.


6. Product Authenticity & Sourcing Policy

Vermart is committed to offering authentic wellness and everyday essential products sourced through trusted retail, wholesale, distribution, brand, and fulfillment partners.

We do not knowingly sell counterfeit products.

Sourcing Model

Products are sourced from reputable retail, wholesale, brand, distribution, and fulfillment partners. Vermart may source products from reputable retailers, wholesale suppliers, authorized distributors where available, brand partners, fulfillment partners, or other trusted commercial sources.

Unless expressly stated, Vermart does not claim to be an authorized reseller, exclusive distributor, official brand store, or manufacturer representative for every product or brand listed.

No Open Third-Party Marketplace

Vermart does not currently operate as an open third-party seller marketplace. Products are curated and fulfilled through Vermart’s own sourcing, retail, distribution, wholesale, brand, or fulfillment partners.

Packaging Differences

Because Vermart serves cross-border customers, product packaging may vary by country or region. Customers may receive products with Canadian packaging, U.S. packaging, bilingual or multilingual labels, updated manufacturer packaging, regional label differences, different promotional packaging, or manufacturer design changes.

Packaging, ingredients, labels, and warnings may vary by region or manufacturer update. Such differences do not necessarily mean the product is inauthentic.

Expiry Dates and Product Condition

Where applicable, Vermart aims to ship products with reasonable remaining shelf life. Expiry date formats may vary by country and manufacturer.

If you have concerns about a product’s expiry date, seal, packaging condition, or authenticity, contact support@vermart.com with your order number and clear photos before using the product.

Brand Ownership

All brand names, trademarks, product names, logos, and manufacturer references belong to their respective owners. Use of brand names on Vermart is for product identification and resale purposes only and does not imply sponsorship, affiliation, authorization, or endorsement unless expressly stated.

False or Misleading Claims
